High Court upholds key part of Obama health law

WASHINGTON (AP) -- The Supreme Court on Thursday upheld the individual insurance requirement at the heart of President Barack Obama's health care overhaul.

The decision means the historic overhaul will continue to go into effect over the next several years, affecting the way that countless Americans receive and pay for their personal medical care. The ruling also handed Obama a campaign-season victory in rejecting arguments that Congress went too far in requiring most Americans to have health insurance or pay a penalty.

Chief Justice John Roberts announced the court's judgment that allows the law to go forward with its aim of covering more than 30 million uninsured Americans.

The court found problems with the law's expansion of Medicaid, but even there said the expansion could proceed as long as the federal government does not threaten to withhold states' entire Medicaid allotment if they don't take part in the law's extension.

The court's four liberal justices, Stephen Breyer, Ruth Bader Ginsburg, Elena Kagan and Sonia Sotomayor, joined Roberts in the outcome.

Justices Samuel Alito, Anthony Kennedy, Antonin Scalia and Clarence Thomas dissented.

This will change many times before all of this is put in place. The only way to kill this and the immigration problem for good is through constitution amendments. As a strong conservation this is hard for me to say, but i believe the court ruled right by the constitution article 8 which gives congress the right to levy tax. Obama and the democrats were smart enough to call this a tax and giving the IRS the power to collect from ones choosing not to get health insurance. It is up to people like me and other conservatives to elect people who can control 2/3 of the houses so as to submit constitution amendment to change this. I believe we have the 3/4th of states to ratify an amendment giving each state the right over immigration since the federal government has failed so much here. Since polls shows most people are against Obama's health care that is the issue conservatives need to push to get control of both houses and the white house.

Correction, Obama said this was not a tax. This may have been a smart move by the conservatives. Now the american people are going to have to pay a tax of about 200.00 the first year for electing not have health insurance. The so called tax gets even higher each year. The Democrats are doing a good job of dumbing down their base so they will believe anything that their doing is good for them. At the end of the day Obama is not going to win a second term, most Americans are smart enough to see his true socialist intentions.

I'm sorry folks, I having a hard enough time paying for my OWN healthcare coverage, I can't pay for these lazy mules that don't want to get out and work for a living (cough, Greenacres, cough..). OUR insurance, by the way, happens to be the cheapest we could get away with, which means our deductables are sky high. Guess if something happens, best if it all happens on the same day!

No, the way to kill this is to vote GOP in November. The majority of common sense people who voted PBO last time were stampeded into doing so by the economic downfall, (that happened because the gov't put deadbeats into homes they couldn't afford), with the MSM, hollywood, and the Dimsters leading the propaganda pack. The public was deceived. PBO promised lower employment with a deficit stimulus, (still hasn't worked), "free" health care for all, (small businesses can't afford, more potential jobs down the drain), plus gay marriage, all of us riding bicycles instead of fossil fuels, more regulation, etc. Anyone impressed by the Dims in the last four years is a hopeless idiot, and indoctrinated moron, or votes PBO for racial reasons. No fair minded, common sense person will vote for PBO this time. Common sense people know what produces, know what works, and what doesn't. If they were fooled last time, there is a mountain of evidence to vote GOP for this vote. Liberalism has never worked, and never will. Gotta get to work, no time to explain that one, but the atheist social engineers in the USSR gave it their best shot, and it still didn't work. Socialist Europe is in economic freefall. Free enterprise is the best system, except for the KOG. Next subject...

This law does for medicine what No Child Left Behind did for education. In fact, the "outcome-based" payment scheme for doctors is almost identical and will have identical results, except doctors will drop the most difficult patients: the ones who need the care the most. It taxes medical savings accounts that are larger than $2500, which is the opposite of what needed to be done. And it is good that the kids can stay on their parents policy until they are 26 since there will be no jobs and they will have to live at home, anyway.

We just took a step closer to the system in the EU...how's that working out for THEM?

Appears Roberts is a fence rider going for whatever President is in office. This is one mistake I'm sure George Bush wish he had back. This does tell you something about the Supreme court. they rule by what they think and not about what is in the constitution. If they ruled by the constitution the vote should be 8 to 0 all the time. Guess they will have to build debtor prisons for the ones who can't pay the tax to the IRS. I thought Obama wanted to simplify the tax code. Just think how much powerful the IRS will be now running the Health system.
